TERMS AND CONDITIONS OF Registration
a. By registering to bid or placing a bid you agree to be bound by all of these terms &
conditions and any other announced terms and conditions of sale or rules of the site.
All Internet bidders agree that bids placed on the Internet shall have the same legal
effect as if they were in attendance at the auction in person.
b. Payment: VISA, MasterCard, Amex & Discover are accepted. Payment will be
expected following the completion of the auction and upon buyer’s receipt of emailed
invoice. Cashier's check and wire transfer are available for payment, but this MUST be
arranged PRIOR TO SALE DATE.
c. All property is sold AS IS, and ALL SALES ARE FINAL. Property is open to thorough
public inspection. It is the Bidders responsibility to determine condition, age,
genuineness, value or any other determinative factor. Bidder shall be the sole judge of
value. Bidders who bid from off site and are not present at the live auction
acknowledge that they may not be able to inspect an item as well as if they examined
it in person. BROWN AUCTION shall endeavor to describe in detail each item and any
pertinent information about it via telephone prior to auction. If you have questions
about the merchandise, the time to ask questions is well in advance of the live
auction. If BROWN AUCTION agrees that the item was misrepresented BROWN
AUCTION will refund the Bidders purchase price to him/her. We want you to be happy
with your purchases. Thank you for your patronage.
d. All Internet Bidders agree to pay a buyers premium equal to Twenty Percent (20%) of
the hammer price of each item they purchase.
e. BROWN AUCTION is providing Internet pre-auction and live bidding as a service to
Bidder. Under no circumstances shall Bidder have any kind of claim against BROWN
AUCTION or anyone else if the Internet service fails to work correctly before or during
the live auction. BROWN AUCTION will not be responsible for any missed bids from
any source. Internet bidders who desire to make certain their bid is acknowledged
should use the pre-bidding “Max Bid” feature and leave their maximum bid 24 hours
before the auction begins.
f. The auctioneer shall advance the bidding at his own discretion. BROWN AUCTION may
withdraw any item before or during the auction. Should a tie or a dispute arise
between two bidders, the auctioneer may, at his discretion, reopen the bidding until
the property is sold. The record of the auction made by BROWN AUCTION shall be
conclusive.
g. Should a dispute arise between BROWN AUCTION and Bidder, Bidder waives any right
to a trial or hearing in a court of law and agrees to settle the dispute through binding
arbitration in Kansas.
h. SHIPPING: All items sold will be available for shipping, unless otherwise stated in the
description of the item (large pieces, furniture, etc.). BROWN AUCTION handles the
shipping themselves and in house. We have shipped thousands of items over several
decades, and are experienced packing fragile antiques and items for third party
transportation. Buyer agrees to pay a $2 per item charge to cover the cost of shipping
materials and packaging labor. Additionally, Buyer agrees to pay for full postage,
including complete insurance to cover entire purchase price. BROWN AUCTION WILL
NOT ship items uninsured. No items will be shipped until purchase price and all
shipping charges are paid for.
i. PICKUP: All items are eligible for pickup either at auction site or at Brown Auction’s
facility in Greensburg, KS depending on logistics of auction locations. Please contact if
you wish to pick up your items upon receipt of your invoice. No items will be picked up
until purchase price is paid in full.
